What is a trade mark lawyer?
In Australia, the two professions of trade mark lawyers and trade mark attorneys are confusingly distinct, though in most cases they undertake the same work.
A trade mark lawyer refers to a solicitor or lawyer who specialises in providing trade mark advice in relation to a trade mark dispute, trade mark registration and trade mark infringement. As a lawyer, they will have successfully completed a law degree and undertaken a minimum requirement of practical legal training.
A trade mark attorney, however, is a person who holds a tertiary qualification (not necessarily a law degree) as well as further qualifications relating specifically to trade marks law.
