US trademark search This will determine whether there are any prior US trademarks that may be too similar to yours and prevent easy registration. We will provide you with a report that outlines how easy or difficult your trademark is likely to be. You may wish to conduct some preliminary searches yourself using the USTPO website.

US trademark application (bundled with AU application)  If you apply for a US and Australian trade mark at the same time, we give you a 33% discount on our US application fees. The price above does not include the Australian application fees.  Choose this option by completing the Australian trade mark application, then selecting the US check box.

US trademark application A stand alone US application. If you’re completely set on your name or logo, or have done your own searches, then a search might not be helpful – because you want to proceed anyway. In that case, it’s better to just apply for your US trademark and wait for the response from the USPTO.

Notes on pricing

Examination Every US trademark is examined by the USPTO to ensure it meets the requirements for registrability in the United States. If there are any issues raised by the USPTO during the examination of your application, we will forward the report with our preliminary comments (for free).

US trademark registration fees All going well, and your trade mark passes government examination, there will then be our registration flat fee of $280 due in around 4 months.

*Classes When applying for a US trademark you need to nominate which goods or services you want your trademark to cover.  There are 45 official classes of goods and services, with a government fee of US$325 per class and our professional fee of $190 (or $127 if bundled).  However, to save our client’s fees, we draft precise and lean trademark applications usually covering one or two classes.  We indicate your main trademark class, and if we think other classes could be important to you, we let you decide if you want to proceed in those extra classes.

 Search classes The US trade mark search fees are on a per class basis. Usually, our client’s applications cover only 1 or 2 classes.  We will work with you to determine which class or classes we will search.
